1. Introduction

Welcome to Nooga Timepieces LLC. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

2. Definitions

  • "We," "Us," "Our": Refers to Nooga Timepieces.

  • "You," "Your": Refers to the user or customer of our website and services.

  • "Website": Refers to www.noogatimepieces.com.

  • "Services": Refers to the buying, selling, and trading of new and used watches.

3. Eligibility

You must be at least 18 years old to use our services. By using our website, you represent and warrant that you meet this age requirement.

4. Account Registration

To use certain features of our website, you may need to register for an account. You agree to provide accurate and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Buying Watches

  • Product Descriptions: We strive to provide accurate descriptions of the watches we sell. However, we do not warrant that the descriptions are accurate, complete, reliable, current, or error-free.

  • Pricing: All prices are subject to change without notice. Prices do not include applicable taxes or shipping and handling charges, which will be added to your total invoice amount.

  • Order Acceptance: We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or errors in your order.

6. Selling and Trading Watches

  • Evaluation: Watches submitted for sale or trade will be evaluated by our experts. We reserve the right to refuse any watch for any reason.

  • Offers: Offers made for your watch are valid for a limited time as specified in the offer. If you accept our offer, you agree to transfer ownership of the watch to us.

  • Payment: Payment for watches sold to us will be made via the method agreed upon during the transaction process.  Credit Cards will be charged a 4% Processing Fee.  Sales Tax will be collected if the customer is a Tennessee Resident.

7. Returns and Refunds

  • Return Policy: You are purchasing a Used/Pre-owned watch which will have signs of previous wear.  Small scratches on the lugs, case, bracelet, or crystal will be described as accurately as possible.  If there is something that was missed in our description and is considerable, we can work toward a resolution.  You have 24 hours from the time the package has been signed by a responsible adult to issue a claim or return the watch for a full refund. All Sales are final after 24 hours.

  •  Refunds: Refunds will be processed within 5 days of receiving the returned watch. Shipping and handling charges are non-refundable.

8. Warranty and Repairs

  • Warranty: We offer no warranties beyond what comes from the manufacturer on all watches sold. 

  • Repairs: We  can offer repair services for watches purchased from us by one of our third party timepiece repair centers.  Please contact our customer service for more details.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use our services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Tennessee, USA, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 14 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
